Patent Registration

Patent is one of the types of Intellectual Property which is given for the inventions which means that if any invention is being done by any individual and the person wants the protection from the society or other inventors that his/her invention should not be copied then at the initial stage provisional patent is granted. Grant of patent mainly depends upon whether the invention had applicability, innovativeness and usefulness and in case these ingredients are not present in that case the application could be rejected.

Here are few of the documents which are needed for patenting:

1. Application form available online/offline
2. Provisional or complete specification of Patent in duplicate and in case the provisional specification is filed; it must be followed by the complete specification within 12 months.
3. Drawing in duplicate (Two Copies) only if necessary.
4. Abstract and relevant information of the invention made by the party in duplicate.
5. Information and undertaking highlighting the number, filing date & current status of each foreign patent application in duplicate.
6. The Priority document according to the direction by the Controller, if in case the priority date is claimed in convention application,
7. Declaration of inventor-ship, if the provisional specification is followed by a complete specification or in case of convention/PCT national phase application.
8. Power of attorney, if a patent is filled through Patent Agent
9. Fees of the Patent registration to be paid in cash/cheque/demand draft as per convenience.

Time period:

Usually it takes 3 to 5 years for getting the patent granted as it is little bit complex process and involves the examination at global level. As the world is developing, new inventions are taking place every now and then granting patent to every invention is not possible thus, it takes longer time period for approval.
